F-gas Portal – Fluorinated Greenhouse Gases – Climate Action

Sehr geehrte Kunden,

wie Sie bestimmt schon mitbekommen haben, hat die EU Kommission zum 15.01.2025 eine neue Verordnung erlassen, die alle Gegenstände mit Klimaanlagen betrifft also auch einen Großteil der PKW und LKW, die in den Export gehen sollen.

Ohne folgende Punkte ist eine Anmeldung der Fahrzeuge beim Zoll deshalb nicht mehr möglich.

1. Jeder gewerbliche Verkäufer braucht eine F-Gas Portal Nummer. Die Information was das ist und wie Sie die bekommen, finden Sie
auf der Webseite der EU: https://climate.ec.europa.eu/eu-action/fluorinated-greenhouse-gases/f-gas-portal_en
2. Für jedes Fahrzeug muss angegeben werden welches Kältemittel in der Klimaanlage eingefüllt ist.
3. Es muss die Menge des Kältemittels angegeben werden. Diese ist zu finden eventuell auf dem Label auf dem Kompressor und im Handbuch des Fahrzeugs.

Als Spediteur haben Sie auch die Möglichkeit sich selbst im F-Gas Portal anzumelden und für Ihre Kunden als zollrechtlicher Anmelder aufzutreten.
Dann müssen Sie aber auch alle Aufzeichnungspflichten erfüllen.

Private Verkäufe sind von der Verordnung bisher ausgenommen. Hier brauchen wir aber dann vom privaten Verkäufer den Kaufvertrag, die Fahrzeugpapiere, eine Ausweiskopie des Verkäufers und eine Vollmacht des Verkäufers das wir die
Zollanmeldung für ihn machen dürfen und sollen.
Wenn Sie ein Fahrzeug ohne Klimaanlage haben, ist dieses von der Verordnung ausgenommen, dies wird aber vom Zoll kontrolliert. Sollte sich bei der Kontrolle herausstellen, dass das Fahrzeug doch eine Klimaanlage hat, müssen Sie mit
Hohen Strafen rechnen.

As you have probably already noticed, the EU Commission issued a new regulation on January 15, 2025, which affects all items with air conditioning systems, including a large proportion of cars and trucks that are to be exported.

Without the following points, it is no longer possible to register the vehicles with customs.

1. Every commercial seller needs an F-Gas portal number. You can find the information about what that is and how to get it

2. For each vehicle it must be stated which refrigerant is filled in the air conditioning system.
3. The amount of refrigerant must be specified. This can possibly be found on the label on the compressor and in the vehicle manual.

As a freight forwarder, you also have the opportunity to register yourself in the F-Gas portal and act as a customs declarant for your customers. But then you also have to fulfill all recording obligations.

Private sales are currently exempt from the regulation. Here we need the purchase contract, the vehicle documents, a copy of the seller’s ID and a power of attorney from the private seller that we are allowed
and should make a customs declaration for him.

If you have a vehicle without air conditioning, this is exempt from the regulation, but this will be checked by customs. If the inspection reveals that the vehicle does have air conditioning, you must do expect high penalties.
